PLEASE READ CAREFULLY! THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!
This Release and Waiver of Liability (the “Release”) executed by (the “Volunteer”) in favor of Habitat for Humanity International, Inc., a nonprofit corporation, and the Iowa Valley Habitat for Humanity, an Iowa nonprofit corporation, their directors, officers, employees, volunteers, and agents (collectively, “Habitat”) and the State of Iowa. The Volunteer desires to work as a volunteer for Habitat and engage in the activities related to being a volunteer (the “Activities”). The Volunteer understands that the Activities may include constructing and renovating residential buildings, working in the Habitat offices, working at Restore, special events, and living in housing provided for volunteers of Habitat.
The Volunteer hereby freely, voluntarily, and without duress executes the Release for himself, his personal representatives, heirs, and next of kin under the following terms:
Release and Waiver. Volunteer does hereby release, forever discharge, covenant not to sue and hold harmless Habitat and its successors and the State of Iowa and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from Volunteer’s Activities with Habitat.
Medical Treatment. Volunteer does hereby release and forever discharge Iowa Valley Habitat for Humanity and the State of Iowa from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with Volunteer’s Activities with Habitat. Please inform a Habitat staff person about performing any volunteer activities which may affect any temporary or permanent health conditions you are aware of.
Assumption of the Risk. Volunteer understands that the Activities may include work that may be hazardous to the Volunteer, including, but not limited to, construction, loading and unloading, and transportation to and from the work sites. Volunteer agrees to inspect the work sites which he/she enters and further agrees and warrants that, if at any time, he/she is in or about a work site and feels anything to be unsafe, will immediately advise a Habitat representative of such and if necessary will leave the work site and/or refuse to participate further in activities.
VOLUNTEER HEREBY EXPRESSLY AND SPECIFICALLY ASSUMES FULL RESPONSIBILITY FOR THE RISK OF BODILY INJURY, HARM, OR DEATH IN THE ACTIVITES AND RELEASES HABITAT AND THE STATE OF IOWA FROM ALL LIABITIY FOR INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RESULTING FROM THE ACTIVITIES.
Insurance. The Volunteer understands that, except as otherwise agreed to by Habitat in writing, Habitat does not carry or maintain health, medical, or disability insurance coverage for any Volunteer. EACH VOLUNTEER IS EXPECTED AND ENCOURAGED TO OBTAIN HIS OR HER OWN MEDICAL OR HEALTH INSURANCE COVERAGE.
Photographic Release. Volunteer does hereby grant and convey unto Habitat all right, title, and interest in any and all photographic images and video or audio recordings made by Habitat during the Volunteer’s Activities with Habitat, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Consent to Sex Offender and Major Crime Check. Volunteer does hereby grant consent for Habitat to undergo a state sex offender and major crime search and understands that in the case of finding their name on either list, Habitat has the right to ask that they no longer volunteer at Habitat. The volunteer hereby confirms that he/she is not on any sex offender or major crime list.
Age Limitations. Volunteer agrees to these limitations: Volunteers under the age of 14 may not enter or volunteer at any Habitat work site undergoing heavy construction. Volunteers under the age of 18 are not permitted to use power tools or work more than 6 feet above ground level at any Habitat work site.
Other. Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Iowa, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Iowa. Volunteer agrees that in the event that any clause or provision of the Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of the Release which shall continue to be enforceable.
